29 CFR 1926.602(d) NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.178(l) of this chapter.       29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):       a)  On or about June 20, 2017, the employer did not train and evaluate the employees operating the JCB all-terrain forklift.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a)  On June 20, 2017, employees performing HVAC and demolition work were exposed to fall hazards of approximately 15'-10" from the roof of a school.
