29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On or about June 21, 2017, employees were laying stone on the commercial building under construction on a tubular welded scaffold approximately 12 feet high working above other employees who were not wearing hard hats, exposing employees to the hazard of being struck by tools or materials.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about June 21, 2017, and at times prior thereto, employees were laying stone on the commercial building under construction working from a tubular welded scaffold that did not have a ladder for access, exposing the employees to a fall hazard.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees: On or about June 21, 2017, an employee used a portable folding masonry table to increase the working height on top of the scaffold to approximately 12 feet high, exposing employees to a fall hazard.
