29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) JLR Construction, LLC., at 4400 S. Louise Ave Sioux Falls SD, 57106: On and before June 26, 2017 the employer did not ensure employees were provided eye protection during the installation of siding on a residential property while utilizing pneumatic nail guns. This condition exposed employees to projectile hazards to the eyes. Abatement Note: 1926.28(a) also provides that the employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.

Louise Ave Sioux Falls SD, 57106: On and before June 26, 2017 the employer did not ensure employees were provided safe extension cords while utilizing power tools. Two employees were working from scaffolding cutting siding material with a circular saw that was attached to an extension cord that had exposed inner conductors below the insulation. This condition exposed employees to electrical shock and burn hazards.

Louise Ave Sioux Falls SD, 57106: On and before June 26, 2017 the employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The scaffold used on the north side of the building lacked midrails and endrails. This condition exposed employees to a fall of approximate 17 feet.

Louise Ave Sioux Falls SD, 57106: On and before June 26, 2017 the employer did not ensure all bracing connections were installed on the Alum-a-pole pump jack scaffold being used by employees, in that rigid triangular bracing or equivalent were missing on the bottom of the scaffold poles. The lack of bracing exposed employees to the hazard of falling up to 17 feet.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: (a) JLR Construction, LLC., at 4400 S. Louise Ave Sioux Falls SD, 57106: On and before June 26, 2017 the employer did not have each employee who performs work while on a Alum-a-Pole pump jack scaffold, installing siding material, trained by a qualified person. This condition exposed the employees to a fall of approximately 17 feet. Abatement Note: The training shall include the following elements at a minimum: (1) The nature of any electrical hazards, fall hazards, and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used: (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffold used; and (5) Any other pertinent requirements of this subpart.

Louise Ave, Sioux Falls SD, 57106: On and before June 26, 2017, the employer did not ensure employees that erected an Alum-a-Pole scaffolding system were provided with adequate training concerning erecting, disassembling, moving, operating, repairing, maintaining or inspecting a scaffold. This condition exposed employees to falls of approximately 17 feet. Abatement Note: The training shall include the following topics, as applicable: (1) The nature of scaffold hazards; (2) The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question; (3) The design criteria, maximum intended load-carrying capacity and intended use of the scaffold; (4) Any other pertinent requirements of this subpart.
