OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crush-by and struck-by hazards:    On or about July 6, 2017, at the construction site of a new multi-use building, framing employees were erecting newly constructed walls that were suspended and supported from a fork of a JLG Sky Trak Model #10054 exposing employees to struck-by hazards.

The employees used a 12' foot step ladder exposing them to fall hazards of approximately 12 feet to the concrete below.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step:  At the construction site of a new multi-use building, the employer did not provide extension ladders for framing employees to disconnect chains from the top of 17 foot 9 inch erected walls. The employees used the top step of a 12' foot step ladder exposing them to fall hazards of approximately 12 feet to the concrete below.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.  At the construction site of a new multi-use building, the employer failed to provide appropriate training and correct ladder use. Employees leaned a 12 foot step ladder against 17 foot 9 inch wall and then used the top step to disconnect chains from the top of the wall exposing them to fall hazards of 12 feet to the concrete below.
