29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck (PIT) operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Diversified Transfer and Storage, Inc. at 5140 Race Ct., Unit 7, Denver, CO 80216: On or about 7/3/2017, the employer failed to ensure that, where PITs are used, each operator's competency was evaluated through a certification course including formal training, evaluation, or certification. Nine employees operated the PITs on site on a daily basis for up to 8 hours per day. Some of the employees have not received PIT training, evaluations, or certifications from Diversified Transfer and Storage.  This condition exposed employees to struck-by, caught-on, and caught-under hazards.

The Denver location was in operation for approximately 7 years at the time of the inspection.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):   a) Diversified Transfer and Storage, Inc. at 5140 Race Ct., Unit 7, Denver, CO 80216: On or about 7/11/2017, the employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). Employees work in the warehouse as order pickers and packers, which often incudes the use of pallet jacks and powered industrial trucks (PITs) such as battery-powered forklift trucks. All 11 operators on site participate in battery charging activities for the forklifts without eye or hand protection. A workplace assessment has not been performed and certified by the employer. This condition exposed employees to corrosive chemical hazards due to sulfuric acid contained in batteries.
