29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. While performing roofing operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employees were exposed to a fall hazard of up to seven (7) feet from the working surface to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer did not ensure that the ladder being utilized to access the roof where roofing operations were being performed was extended at least three feet above the landing surface of the roof. It was extended approximately 18 inches. The employee was exposed to a fall hazard of approximately seven (7) feet from the eave to the ground below.
