29 CFR 1910.22(d)(1): (1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition; On July 12, 2017, there were no regular inspections being performed by the employer to ensure walking-working surfaces at the jobsite, such as the aerial lift platform, were being maintained in a safe condition. Located on the east side of a commercial structure, an employee was observed working from a Genie S-65 extendable boom lift without being attached to the boom or basket. Potential fall heights were measured to be greater than 16 feet above the concrete surface below.

29 CFR 1910.30(a)(1): (a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On July 12, 2017, an employee observed working from a Genie S-65 extendable boom lift, without being attached to the boom or basket, that was not provided training to recognize the associated fall hazards & equipment hazards; and to understand the procedures to control or minimize those hazards. Potential fall height was measured to be greater than 16 feet above the concrete surface below while not utilizing a fall protection system.
