29 CFR 1910.178(p)(1):   A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck and was not  be taken out of service until it had been restored to safe operating condition.  On about 7/11/2017, employees at Shapiro Metal Supply Company were operating defective powered industrial trucks in need of repair that were not removed from service until they had been restored to safe operating condition.  The following powered industrial trucks were in use onsite:  a)  Datsun powered industrial truck (PIT), Model CPF02A20V: The LPG tank indexing/locator pin was missing; the tank was installed incorrectly and the unit was missing brake lights.  b)  Clark PIT; Model GCX25, Serial # GX230-0340-9140K0F: The LPG tank indexing/locator pin was missing; the LPG tank was installed incorrectly; the side panel was missing; the battery was not properly installed/secured; the LPG tank hold-down strap was damaged; the parking brake was inoperative and the unit was missing brake lights.    c)  Toyota PIT, Model 52-6FGCU30, Serial # 61039:  The unit was missing brake lights; the seat was damaged and the LPG tank was installed incorrectly.    d)  Yale PIT, Serial # 0828090:  The seat was broken.  The LPG tank indexing/locator pin was missing and tank was installed incorrectly.    e)  Mitsubishi PIT, # 0L2; was missing brake lights.

Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. Defects when found were not immediately reported and corrected.  On about 7/11/2017, Shapiro Metal Supply Company had not examined their powered industrial trucks before placing them in service.
