OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  On or about July 17, 2017 employees were exposed to fall to lower level hazards while standing on a steel pallet and lifted 10.5 feet by a forklift to access the roof and no fall protection was used.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provided for frequent and regular inspection of the jobsite to be made by a competent person:   On or about July 17, 2017, employees were exposed to fall hazards of 12 feet while performing roofing activities on the north end of a commercial roof and a competent person did not conduct an inspection of the job site to identify and eliminate the hazards.  Abatement documentation required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems:  On or about July 17, 2017, employees were exposed to fall hazards of approximately 12 feet while performing roofing activities on the north end of a commercial roof and a suitable fall protection system was not used.  Abatement documentation required for this item in accordance with 29 CFR 1903.19(d).
