29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  (a)JCR, LLC at 725 E. Kevin St., Tea, SD 57064:  On and prior to July 14, 2017, the exposing employer did not ensure employees were protected from injury, in that five employees engaged in roofing activities on a commercial building, with a roof pitch of approximately 4/12, were not utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) JCR, LLC., at 725 E. Kevin St., Tea, SD 57064:  On and prior to July 14, 2017,  the exposing employer did not ensure that each employee engaged in roofing operations on a commercial building, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. This condition exposed employees to a fall hazard and a fall height of approximately 10 feet.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service:  (a)JCR, LLC., at 725 E. Kevin St., Tea, SD 57064: On and prior to July 14, 2017, the exposing employer did not ensure personal fall arrest systems that were damaged were removed from service. Numerous ropes were frayed and a lanyard had a nail that penetrated through it. This condition exposed employees to the use of deficient fall protection systems which could have result in serious injury in the event of a fall. This condition exposed employees to the hazard of approximately 10 feet.
