OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to lacerations and amputation hazards:  (a)  On or about July 26, 2017, and at times prior thereto, employees were permitted to use handheld circular saws to cut materials while resting the work piece on the worker's toes and leaning it against the worker's legs. 29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)  On or about July 26, 2017, and at times prior thereto, employees were permitted to use a circular skilsaw to cut materials while resting the work piece on their toes and leaning it against their shins exposing himself to potential amputation hazards. 29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On or about July 26, 2017, and at times prior thereto, employees observed setting trusses and walking on the exterior top place without using any means of fall protection and exposed to a 20 foot fall hazards. 29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee had been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:  (a)  On or about July 2017, and at times prior thereto, the responsible person on site and employees performing framing activities did not recognize the hazards of working without fall protection and/or take appropriate actions to minimize and/or eliminate these hazards.
