29 CFR 1910.132(d): Hazard assessment and equipment selection.    29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:  29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment.  a. On or before August 2, 2017 where employees operated powered equipment such as, but not limited to chain saws, the employer did not conduct a hazard assessment to include selecting and requiring employees to use PPE to protect employees from the hazards.

On or before August 2, 2017 the employer did not conduct and certify a hazard assessment of the worksite, thereby exposing employees to struck-by, crushed-by, and other hazards.

29 CFR 1910.151(b): In the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available.  a. On or before August 2, 2017 where employees conducted tree trimming operations, the employer did not ensure a person was adequately trained to render first aid when there was no infirmary, clinic, or hospital in near proximity to the worksites.

29 CFR 1904.39(a)(1): Basic Requirement.  Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  a. On July 31, 2017 at approximately 2:15 pm a workplace fatality occurred in which the employer failed to report the fatality within 8 hours.
