OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to operate a powered industrial truck without wearing a seatbelt:  a)  At 174 Northlake St. Pike Road, Alabama:  On or about August 10, 2017 and at times prior; the employer exposed his employees to crush hazards in that he allowed his employees to operate a powered industrial truck (Lull) without wearing a seatbelt.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  At 174 Northlake St. Pike Road, Alabama:  On or about August 10, 2017 and at times prior; the employer allowed his employees to work from a ladder jack scaffold without fall protection exposing them to a fall hazard of up to 18 feet to the ground below.
