29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about August 15, 2017, employees working in an excavation up to 7 feet deep were exposed to cave-in hazards and the excavation was not inspected by a competent person before the employees were allowed to enter the working area.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) sloping and benching systems, or paragraph (c) support systems, shield systems, and other protective systems: On or about August 15, 2017, employees working in an excavation up to 7 feet deep were exposed to cave-in hazards and the employer did not ensure the excavation was sloped, shored, or braced in accordance with the standard.
