29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) For jobsites alongside Bruce B Downs, as occurring between May, 2017 and August, 2017, employees were working in excavations that were deeper than 5 feet. Employees were not aware of excavation hazards and how to prevent those hazards.

29 CFR 1926.652(g)(2): Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted: a) For the excavation on Bruce B. Downs near Wharton High School observed on or about 08/17/2017, the excavation extended 2.5 - 3.5 feet below the bottom edge of the trench shield. This condition exposed employees to struck-by hazards in event of a cave-in and/or shifting of the box/shield.

29 CFR 1926.652(b): The slopes and configurations of sloping and benching systems were not in accordance with the requirement options of 29 CFR 1926.652(b)(1), (b)(2), (b)(3), or (b)(4): a) For the excavation on Bruce B. Downs near Wharton High School as observed on or about 08/17/2017, the south end of the excavation was measured to have a slope of 44 - 52 degrees. The soil was type C, and cave-in protection was not being used at the south end of the excavation. Employees were observed working in the excavation laying pipe and were exposed to cave-in hazards from the unprotected south end of the excavation.
