29 CFR 1926.59: NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.  29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Martel General Construction did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling and other forms of warning; 2) Safety data sheet availability; 3) Employee information and training; 4) A list of hazardous chemicals known to be present in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to provide other employer(s) access to safety data sheet; information on any precautionary measures and the labeling system used in the workplace.  6478 N. Northwest Highway, Chicago, IL 60631 - On August 23, 2017, employees were exposed to a hazardous chemical, crystalline silica, when using a saw to remove brick mortar and during brick laying activities on a residential building.  Crystalline silica was a component of the mortar being cut and the Brixment i.pro masonry cement being used at the worksite.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Northwest Highway, Chicago, IL 60631 - On August 23, 2017, Martel General Construction did not ensure that a Safety Data Sheet (SDS) for each hazardous chemical that employees were exposed to was available in the workplace.  Employees were exposed to crystalline silica when using a saw to remove brick mortar and during brick laying activities on a residential building.  The employer did not have a SDS for crystalline silica, a component of the mortar being removed and the Brixment i.pro masonry cement being used at the worksite.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

(b) On August 23, 2017, Martel General Construction did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
