29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: a) 325 Whippany Road, Building #6, Whippany, NJ. The employer had not ensured the employee was given eye protection as the worker was exposed to penetrating eye trauma from nails while using the pneumatic nailer. Violation observed on or about 08/24/2017.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 325 Whippany Road, Building 6, Whippany, NJ. Employees placing sheathing were exposed to falls of 17'7" to the second floor from the trusses and exposed to falls of 21' from the roof's eave to the ground below at this new townhome construction as their fall protection equipment was not being utilized. Violation observed on or about 08/24/2017. b) 325 Whippany Road, Building 6, Whippany, NJ. Employee was exposed to falls of 13'9" to the ground below while installing lower roof trusses as his fall protection equipment was not being utilized. Violation observed on or about 09/01/2017.
