29 CFR 1910.178(l)(1)(i): The employer had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l) and as referenced by the note contained in 1926.602(d):    a.  On or about August 10, 2017, and at times prior, at the front parking lot of the hotel, the employer allowed an employee who had not completed forklift safety training and evaluation to operate a forklift and exposes employees to struck-by hazards.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.    a.  On or about August 9, 2017, and at times prior, at the south exterior side of the hotel, forklift truck operations did not meet the requirements of ASME B56.1-1969 in that the forklift truck was not attended by the forklift operator when the forks were elevated, and the horn, backup alarm, and a tail light did not function and exposes employees to struck-by hazards.
