On or about August 9, 2017, and times prior, at the south exterior side of the hotel, from a 2nd floor window opening a worker stepped onto a wooden box that was supported by a rough terrain forklift truck. The wooden box was not constructed in accordance with ANSI/ITSDF 56.6 and exposes employees to fall hazards and struck-by hazards.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a. On or about August 9, 2017 and at times prior, at the south exterior side of the hotel, a rough terrain forklift truck supported a wooden box and a worker entered the wooden box from a 2nd floor window opening. The wooden box was not approved for use by the forklift truck manufacturer and exposes employees to fall hazards and struck-by hazards.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. a. On or about August 9, 2017, and at times prior, at the south exterior side of the hotel, forklift truck operations did not meet the requirements of ASME B56.1-1969 in that the forklift truck was not attended by the forklift operator when the forks were elevated, and the horn, backup alarm, and a tail light did not function and exposes employees to struck-by hazards.
