29 CFR 1926.251(a)(6): "Inspections." Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service. Robert J. Immel Excavating, Inc. project site located on Tesch St. Brillion, WI: On and about August 23, 2017, the competent person did not remove from service a damaged synthetic sling before using the sling to lift a sewer grate from the curb box.

Synthetic web slings shall be immediately removed from service if any of the following conditions are present: 29 CFR 1926.251(e)(8)(iii): Snags, punctures, tears or cuts; Robert J. Immel Excavating, Inc. project site located on Tesch St. Brillion, WI: On and about August 23, 2017, employees were exposed to being struck by falling objects when a damaged synthetic sling had not been removed from service and was being used to lift a cast iron sewer grate.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. Robert J. Immel Excavating, Inc. project site located on Tesch St. Brillion, WI: On August 23, 2017, employees were working in an 6.1' deep, 10' wide, 13' long excavation where water was accumulating when no precautions had been taken to prevent the water from accumulating or to remove the water that was accumulating, nor were steps taken to protect the employees from possible collapse of the saturated type B soil.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: 29 CFR 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. Robert Immel Excavating, Inc. project site located on Tesch St. Brillion, WI: On August 23, 2017, employees working in a 6.1' deep, 10' wide, and 13' long excavation in saturated type B soil were not protected from cave-in by a protective system or appropriate benching or sloping.
