29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) New residential construction located on Lot #7, Rear side: On or about 08/28/2017, and at times prior, the employer exposed employees to overhead struck-by hazards while hoisting masonry materials to the work level of the scaffold, in that employees were not wearing protective helmets at ground level while loading the scaffold.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):    (a) New residential construction located on Lot #7, Rear side: On or about 08/28/2017, and at times prior, the employer exposed employees to fall hazards of 13-feet, 5-inches to the lower level, in that a fully planked work platform was not provided on the tubular welded scaffold platform as employees were engaged in masonry activities.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.      (a) New residential construction on Lot #7, Rear side: On or about 08/28/2017, and at times prior, the employer exposed employees to fall hazards of up to 13-feet, 5-inches to the lower level, in that safe access (i.e. ladder) was not provided to the work platform of the tubular welded scaffold platform. Employees climbed the walk-through type frames to engage in masonry work on the work platform.

(a) New residential construction located on Lot #7, Rear side: On or about 08/28/2017, and at times prior, the employer exposed employees to fall hazards of approximately 13-feet,5-inches to the lower level, in that a fall protection system was not provided to an employees engaged in masonry activities on a tubular welded scaffold platform.
