29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) The employer did not ensure that each employee shingling the roof of a multi-story house being built at 4921 Durham Drive, Plano, TX approximately ten (10) feet or more above the ground level below was protected from a fall hazard by using either guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed; the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a) The employer did not ensure that extension ladders utilized by employees were properly placed with three (3) feet of its side rails above the upper landing to assist employees mounting and dismounting the ladder when a ladder was observed at a worksite located at 4921 Durham Drive, Plano, TX to be only approximately one foot above the upper landing thereby exposing the employees using it to a fall hazard of approximately ten (10) feet to the ground below.
