29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access:  a) Front and Side of Garage - On or about September 1, 2017, employees working on the first and second levels of a two tier tubular welded frame scaffold accessed the upper levels that were more than 2 feet above or below a point of access by climbing the ends of the scaffold, which were not equipped with suitable means of access, thus exposing employees to fall hazards of up to approximately 10 feet onto earthen ground.  b) Side of Garage - On or about September 1, 2017, an employee working on the balcony under the rear second story windows used a two tier tubular welded frame scaffold to access upper levels of the scaffold that were more than 2 feet above or below a point of access to get up to the first story roof by climbing the ends of the scaffold, which were not equipped with suitable means of access, thus exposing employees to fall hazards of up to approximately 10 feet onto earthen ground.
