Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:     a) Parking Lot of Nursery - On September 7, 2017, an employee was exposed to a fall of approximately eight feet when the employee was raised by a Komatsu 15 forklift while standing on a pallet without any means of fall protection.    Among other methods, one feasible and acceptable means of abatement to correct this hazard is to provide and require the use of a work platform designed to lift personnel in accordance with the American Society of National Standard (ANSI), B56.1-2012 Safety Standard for Low Lift and High Lift Trucks, Section 4.17.

The forklift operator was greater than 25 feet away from the forklift.

This forklift was being operated with a damaged load back rest.
