29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  In the Facility, on or about September 28, 2017 - The employer did not institute a continuing effective hearing conservation program when employee noise exposures exceeded an 8-hour time-weighted average sound level of 85 dBA.  An employee designated as a Block Machine Operator was exposed to noise at a level of 227% of the allowable limit during a 306 minute sampling period on September 28, 2017.  This exposure is equivalent to a sound level of 95.9 dBA for the dose and time of employee exposure and is 4.5 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.    b)  In the Facility, on or about September 28, 2017 -  An employee designated as a Mixer/Operator was exposed to noise at a level of 75.6% of the allowable limit during a 309 minute sampling period on September 28, 2017.  This exposure is equivalent to a sound level of 87.9 dBA for the dose and time of employee exposure and is 1.5 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.    c)  In the Facility, on or about September 28, 2017 -  An employee designated as a Laborer was exposed to noise at a level of 72.3% of the allowable limit during a 307 minute sampling period on September 28, 2017.  This exposure is equivalent to a sound level of 87.6 dBA for the dose and time of employee exposure and is 1.4 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.
