29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:    a- 12 Vance Avenue, Lavallette NJ: On or about 09/14/17 a company worker, being lifted to the walking/working surface of a residential structure from a wooden platform that was resting on the forks of a JLG 6042 All terrain fork truck, was exposed to fall hazards in excess of 14 feet the ground surface below. This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform.      NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a- 12 Vance Avenue, Lavallette NJ: On or about 09/14/17 a company worker, being lifted to the walking/working surface of a residential structure from a wooden platform that was resting on the forks of a JLG 6042 All terrain fork truck, was exposed to fall hazards in excess of 14 feet the ground surface below.  This employee was not utilizing any fall protection at the time of the exposure.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a- 12 Vance Avenue, Lavallette NJ: On or about 09/14/17, a company worker was performing siding installation and other related activities from a pitched roof without the use of any fall protection.  As such this employee was exposed to fall hazards in excess of 14 feet the ground surface below.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
