29 CFR 1926.501(b)(11): Employees on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems: (a)Jose Antonio Navas Construction at 900 East 20th Street in Sioux Falls, SD 57105: On and prior to August 30, 2017, the exposing employer did not ensure employees were using a fall protection system when performing roofing activities on a 5/12 inch sloped roof. The employees were engaged in tear-off activities on the roof. This condition exposed employees to fall hazards of approximately 20-feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Jose Antonio Navas Construction at 900 East 20th Street, Sioux Falls, SD 57105: On and prior to August 30, 2017, the exposing employer did not ensure that each employee engaged in roofing operations on a commerical building, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 20-feet.

This condition exposed employees to a fall hazard of approximately 20 feet when accessing or egressing the roof.
