29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    A) On or about September 19, 2017, the employer had not developed a written workplace specific energy control program.     An effective energy control program includes, but is not limited to the following:  1) The development and implementation of a written energy control program   2) The development, documentation and utilization of energy control procedures  3) Training employees servicing and/or maintaining equipment on the energy control procedures to be utilized  4) Compliance enforcement statement  5) Providing the needed hardware to perform the energy control procedures  6) Develop and implement a periodic inspection of the energy control procedures and utilization  7) Train employees not utilizing energy control procedures on the purpose and use of the energy control procedures  8) Develop and implement a procedure to remove energy control devices when the employee who applied the energy control device is not present  9) Documenting employee training and periodic inspections

29 CFR 1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.    a) On or about September 19, 2017, the employer had not trained employees performing equipment maintenance and servicing activities the appropriate energy control procedures to be utilized.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    a) On or about September 19, 2017, the Dewalt DW713 Chop Saw exposed blade sides were not guarded with self-adjusting guards in the Production Area.    b) On or about September 19, 2017, the Scottman Industries Chop Saw exposed blade sides were not guarded with self-adjusting guards in the Production Area.    c) On or about September 19, 2017, 6 inches of the unused area saw blade was not guarded on the Baileigh Horizontal Band Saw in the Production Area.

29 CFR 1910.303(b)(7)(iv): There shall be no damaged parts that may adversely affect safe operation or mechanical strength of the equipment, such as parts that are broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating.    a)  On or about September 19, 2017, the FMB Orion Horizontal Band Saw exterior reset switch did not work. Employees needed to enter the FMB Orion Horizontal Band Saw cabinet, when energized, to reset the anti-restart device to the Band Saw. The FMB Orion Horizontal Band Saw cabinet was also damaged and could not be correctly closed. Employees were exposed to 480 volt electrical contacts.

29 CFR 1910.1026(l)(1)(iii): Employers shall include chromium (VI) in the hazard communication program established to comply with the HCS (� 1910.1200). Employers shall ensure that each employee has access to labels on containers of chromium (VI) and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l)(2) of this section.    a) On or about September 19, 2017, welders working with stainless steel had not received training concerning the health hazards associated with chromium (VI) and on the contents of 29 CFR 1910.1026 Chromium (VI).
