29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairways in and around buildings or other structures:    (a) Black Hills Construction, LCC @ 1205 Pace Street, Longmont, CO 80501:  On or before September 19, 2017 as part of injury/ accident prevention responsibilities under its safety program, the exposing employer did not ensure that the scrap lumber with protruding nails, and all other debris, was be kept cleared from work areas, passageways and around the stairways located in the middle of the building where employee used a ladder to gain access to the upper floor. Scrap lumber with protruding nails, and all other debris was accumulated and around buildings or other structures instead of being contained inside trash dumpsters on the jobsite.  This condition exposed employees to tripping/falling and puncture hazards due to 2x4s having nails sticking up.

29 CFR 1926.100(a):  Employees were not protected by hard hats while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects:      (a) Black Hills Construction, LCC @ 1205 Pace Street, Longmont, CO 80501:  On or before September 19, 2017, as part of injury/accident prevention responsibilities under its safety program, the exposing employer did not ensure that each employee wore hard hats while working on the jobsite. No employee was wearing a hard hat including both management officials onsite. This condition exposed employees to head injury from impact, or from falling or flying object from the upper floor elevations.       Abatement Note:  1926.28(a) also provides that the employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.
