29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:    (a)Don Bruns Construction@ 21008 484th Ave., Elkton, SD 57026: On and prior to September 11, 2017, the employer did not ensure employees were adequately instructed in the recognition of hazards associated with the use of skid steer attachments. Specifically, the employer failed to recognize that workers involved in connecting the Edge forklift attachment to the carriage of the Mustang MTL 320 skid steer did not take the necessary steps to ensure the locking pins were seated correctly. On September 11, 2017, three employee were working on a personnel platform when the forklift attachment that secured the platform to the skid steer, released, causing three workers to fall and be seriously injured. The employer did not provide sufficient instruction in ensuring the forklift attachment was verified through mechanical or visual means prior to using the personnel platform. This condition resulted in a fall which caused an employee to fracture his leg and another employee suffered a concussion.

29 CFR 1926.451(a)(1): Scaffold and scaffold components were not capable of supporting, without failure, their own weight and at least four times the maximum intended load applied or transmitted to it:    (a)Don Bruns Construction@ 21008 484th Ave., Elkton, SD 57026: On and prior to September 11, 2017, the employer did not ensure that the supported scaffold was capable of supporting, without failure, its own weight and at least four times the maximum intended load applied or transmitted to it. A personnel platform that was connected to and resting on a forklift attachment, failed when the forklift attachment separated from the skid steer carriage and fell to the concrete floor below. Three employees engaged in concrete work stood on one end of the platform causing it to tilt and the forklift attachment to disengage. The condition exposed employees to a fall hazard of approximately 8-feet, causing serious injury.
