29 CFR 1926.20(b)(2): Accident prevention responsibilities.  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about September 28, 2017, the contractor failed to initiate and implement an accident prevention program which includes frequent and regular inspections of their job sites to ensure subcontractor employees were not exposed to fall hazards while performing roofing work.

29 CFR 1926.501(b)(11): "Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  On or about September 28, 2017, HBJL Construction, Inc. and D' Best Construction, Inc. employees were exposed to fall hazards of over 30' without utilizing their personal fall arrest systems while re-roofing a three story hotel located at 850 Kepler Dr. Green Bay, WI 54311.
