29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    a.) Wood Shop Area - On or about November 2, 2017, An employee, who was fabricating decking was exposed to continuous noise at 90.2% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 89.3 dBA. This exposure was observed occurring over a 374 minute sampling period on 11/2/17. A zero exposure was assumed for the 106 minutes not sampled.  The employer did not conduct monitoring to determine what requirements from the Noise standard 1910.95 were needed to protect the employees.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :   a.) Wood Shop Area - On or about November 2, 2017, An employee, who was fabricating decking was exposed to continuous noise at 90.2% of the exposure level of 90 dBA or an eight hour time weighted average (TWA) noise exposure of 89.3 dBA. This exposure was observed occurring over a 374 minute sampling period on 11/2/17. A zero exposure was assumed for the 106 minutes not sampled.  The employer did not obtain an annual audiogram for this employee previously tested on February 19, 2016.

Wood Shop Area - On or about November 2, 2017, and employee was cutting wood 4" x 4"s, with a Dewalt radial arm saw which did not have the lower guards attached, exposing the employee to the hazards of contact with the saw blade.
