29 CFR 1910.28(b)(15): The employer did not ensure that each employee on a walking-working surface, not otherwise addressed elsewhere in this section, that was 4 feet (1.2m) or more above a lower level was protected from falling by a guardrail system, safety net system, or a personal fall protection system:  (a) On or about October 10, 2017 and dates prior to for employees exposed to falls of approximately 11 feet while working from the top of tank cars at the rail spur offload site located south of the employer's facility at 2351 Business Loop 94  in Mandan, North Dakota.  (b) On or about October 10, 2017 and dates prior to for employees exposed to falls of approximately 11 feet while using the articulated steps to access the top of the rail cars while offloading acid at the rail spur offload site located south of the employer's facility at 2351 Business Loop 94 in Mandan, North Dakota.
