OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard while performing tree trimming work: a. 618 Holman Avenue, Athens, GA (Residential Vacant Lot) - Employee/Owner was exposed to fall hazard. The owner was in the process of cutting tree limbs approximately 60-80feet above ground level without utilizing the proper means of fall protection. The employee/owner did not have a minimum of two means of being secured while working aloft, such as but not limited to an arborist climbing line and a work positioning lanyard (ANSI Z133.1 October 2000, Section 9.1.3)which constitutes a means of fall protection system, on or about October 5, 2017.

29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: a. 618 Holman Avenue, Athens, GA (Residential Vacant Lot) - Employees (Owner and Assistant) were exposed to struck-by hazard. The employees were not require to utilize eye protection when cutting tree limbs, to prevent wood debris particles for flying into the employees eyes, on or about October 5, 2017.

The employees were not require to utilize head protections when cutting tree limbs and/or working in the area where to trees are located, to prevent tree limbs from striking employees as limbs fall to the ground, on or about October 5, 2017.
