A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth:  Jobsite) On October 6, 2017 and at times prior thereto a ladder was not in place for employee use while working in a trench.  The trench measured 4 feet to 4.7 feet deep.    Note) Corrected during inspection.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions could be taken to ensure their safety:  a) Jobsite: On October 6, 2017 and at times prior thereto the competent person on site did not take the necessary precautions prior to allowing an employee to work in a trench without a safe means of egress.  The trench was 4 to 4.7 feet deep.    b) Jobsite: On October 6, 2017 and at times prior thereto the competent person on site did not ensure that the excavated material and other construction items were set back at least 2 feet from the edge of the trench.    Note) Certification of corrective action is required.

29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with, and did not wear, warning vests or other suitable garments marked with or made of reflectorized or high-visibility material:  Jobsite) On October 6, 2017 and at times prior thereto an employee was not wearing a reflective vest of other highly visible garment when assisting with work being done in a trench located on a well, travelled public roadway. 29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations:  Jobsite) On October 6, 2017 and at times prior thereto excavated material and other tools and equipment were not placed at least two feet back from the edge of the excavation.  Items placed at the edge of the excavation included, but were not limited to a bucket, a power saw and hand tools.     Note) Certification of corrective action is required.
