29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): (a) New townhome construction located on Lot #13, Front side: On or about 10/13/2017, and at times prior, the employer exposed employees to falls while working from a pump jack work bench and working on a pump jack scaffold platform at heights over 10-feet without a fall protection system in place, in that the employer did not perform regular inspections of the project and/or employees making sure the siding mechanics were utilizing their PPE and fall protection.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: (a) New townhouse construction located on Lot #13, Front side: On or about 10/13/2017, and at times prior, the employer exposed employees to fall hazards of 10-feet, 3-inches from the lower level, in that a fall protection system was not provided to employees installing siding on a pump jack scaffold system.
