29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).       (a)Welter Steel , Inc. at 45144 289th Street, Viborg, SD 57070: On or about and at times prior to October 3, 2017, the exposing employer did not ensure that the forklift operator had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3). Employees operated the Terex TH842C and Terex TH636C rough terrain forklifts to place bundles of corrugated metal roof panels on the roof. This condition exposed employees to struck-by hazards and improper operation of the forklift.       Abatement Note:  The certification shall include:       (1)The name of the operator;   (2)The date of the training;   (3)The date of the evaluation; and,   (4)The identity of the person(s) performing the training and evaluation.       Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.     Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at 1910.178(l) of this chapter.

29 CFR 1926.20(b)(2):  The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)Welter Steel , Inc. at 45144 289th Street, Viborg, SD 57070: On or about and at times prior to October 3, 2017, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees and subcontractor employees were exposed to fall hazards associated with corrugated metal roof deck installation. This condition exposed employees and subcontractor employees to fall hazards of approximately 21 feet.        Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer did not institute a training program and ensure employee participation in the program:    (a)Welter Steel, Inc. at 45144 289th Street, Viborg, SD 57070: On or about and at times prior to October 3, 2017, the employer did not ensure employees engaged in the installation of steel corrugated roof panels were appropriately trained on fall hazard identification, recognition and methods to guard against falling. This condition exposed the employee to a fall of approximately 21-feet.         Abatement Note: The following provisions supplement the requirements of 29 CFR 1926.21 regarding the hazards addressed in this subpart.        (a)Training personnel. Training required by this section shall be provided by a qualified person(s).         (b)Fall hazard training. The employer shall provide a training program for all employees exposed to fall hazards. The program shall include training and instruction in the following areas:         1)The recognition and identification of fall hazards in the work area;   2)The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used;   3)The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    4)The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and    5)The fall protection requirements of this subpart.        (c) A qualified person means one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems relating to the subject matter, the work, or the project.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.    (a)Welter Steel , Inc. at 45144 289th Street, Viborg, SD 57070:  On or about and prior to October 3, 2017, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was 15 feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system. Employees were engaged in installing insulation and corrugated steel roofing panels without the use of a fall protection system. This condition exposed the employees to a fall hazard of approximately 21 feet.
