29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace: (a) On and before 10/23/2017, at jobsite, for the painters wearing a 3M half face respirator while scraping paint off the fascia of a house containing chemicals such as, but not limited to, lead. The employees were not provided a medical evaluation prior to being required to wear the respirator.

29 CFR 1910.134(f)(2): The employer did not ensure that employees using tight fitting face piece respirators pass an appropriate qualitative or quantitative fit test prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) On and before 10/23/2017, at jobsite, for the painters wearing a 3M half face respirator while scraping paint off the fascia of a house containing chemicals such as, but not limited to, lead. The employees were not fit tested, either qualitatively or quantitatively, prior to being required to use this respirator by the employer.
