29 CFR 1910.178(l)(1)(i): Operators were not trained in the safe operation of powered industrial trucks:     (a)Lowe Construction, LLC at 2201 South Meadowview, Sioux Falls, SD 57110: On and prior to October 24, 2017, the employer did not ensure employees were trained in the operation of powered industrial trucks in that the operators were not trained in the use of the GEHL rough-terrain forklift prior to their use. This condition exposed the employees to the hazard of improper forklift operation.     Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)Lowe Construction, LLC at 2201 South Meadowview, Sioux Falls, SD 57110: On and prior to October 24, 2017, the employer did not ensure employees were protected from injury, in that one employee and the owner were on the roof of a residential property not utilizing a fall protection system, while installing a dormer. This condition exposed employees to a fall hazard of approximately 11 feet 4 inches to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)Lowe Construction, LLC at 2201 South Meadowview, Sioux Falls, SD 57110: On and prior to October 24, 2017, the exposing employer did not ensure that each employee engaged in framing operations on a single-family home, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The employer did not provide training on the simple saver fall protection system involving it's limitations and use. The condition exposed employees to the hazard of falling from an elevation of approximately 11 feet 4 inches.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Lowe Construction, LLC. at 2201 South Meadowview, Sioux Falls, SD 57110: On and prior to October 24, 2017, the employer did not ensure that the ladder that was being used to gain access to a residential roof, was extended at least 3 feet above the upper surface to ensure safe operations for employees.  Employees were using a ladder to access the roof to install a dormer. This condition exposed employees to a fall hazard of 11 feet 4 inches.
