29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:      a) On or about 10/20/17, on the roof of a building at 50 Elk Street, Buffalo, NY:  Employees were engaged in the installation of an EPDM roofing system on the flat roof of the building that was approx. 22 ft. above the ground.   Among other fall protection systems permitted by the standard, the employer chose to use a combination of warning line system and safety monitoring system to protect employees from falling off the roof.  However, in some areas of the roof , the warning line was not present, and in other areas the warning line had sagged to less than the required  34 inches above the surface.  Additionally, the employees were spread out in different areas of the roof at times, and were not being watched by a designated monitor at all times.  The monitor sometimes had his back to employees that he was monitoring, and was also doing other things such a moving warning lines around & refastening the warning lines to the stanchions. This took his attention away from the monitoring function.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1052(a)(3): Riser height and/or tread depth was not uniform within each flight of stairs, including any foundation structure used as one or more treads of the stairs:      a) On or about 10/20/17, on the stairway used to access the roof of a building at 50 Elk Street, Buffalo, NY:  Employees  used  a metal stairway to access and exit the roof. The stair that was supposed to be in place just below the landing was missing, exposing an opening that employees could step into.      NO ABATEMENT CERTIFICATION REQUIRED
