29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems, as required by sub-items A through D of this section. On or about October 23, 2017, the employer's fall protection program did not address or require that employees use fall protection when walking on a roof with skylights. An employee fell through a skylight and was hospitalized on October 10, 2017. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.30(a)(1): The employer did not provide training on or before May 17, 2017 for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before the employee was exposed to a fall hazard: On or about October 23, 2017, the employer's fall protection training was in adequate for the following: a. employees were not instructed on the proper procedures when working around skylights b. employees were not properly instructed on OSHA regulations for working within 6 feet of an unguarded edge c. employees were not properly instructed on OSHA regulations for working between 6 and 15 feet of an unguarded edge including the proper use of designated areas d. employees were not properly instructed that fall protection is required when the fall distance is 4 feet In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1904.39(a)(2): 29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov: On or about October 10, 2017, an employee was performing pest control services at the worksite located at 5466 New Peachtree Road in Chamblee, Georgia. The employee was hospitalized for injuries sustained after falling from the roof. The employer failed to report the hospitalization within 24 hours. The employer contacted OSHA on or about October 17, 2017. No abatement certification or documentation is required for this item.
