OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards while working on a bending machine without emergency stops.    On or about October 13, 2017, operate the National roll bending machine rollers as part of the bellow manufacturing process.  Employees were exposed to amputation hazards when emergency stops were not available on the front and back of the roller machine or for an employee with both hands caught in the rollers.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):    a. On or about October 26, 2017, employees were exposed to caught-in hazards when the Paradise roll bending machine in the bellows department was not guarded to prevent employees from getting caught in the rollers when feeding sheet metal into the rollers.    b. On or about October 26, 2017, employees were exposed to struck-by and amputation hazards when the guard on the front of the shear permitted access to the hold down clamps.    c. On or about October 26, 2017, employees were exposed to struck-by and amputation hazards when the back side of the shear was not guarded to prevent accidental contact when working in the area near the scrap bin.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.133(b)(1): Protective eye and face devices purchased after July 5, 1994 did not comply with ANSI Z87.1-1989, "American National Standard Practice for Occupational and Educational Eye and Face Protection:    On or about October 26, 2017, employees were exposed to struck-by hazards when handling sheet metal while wearing prescription glasses that did not comply with the ANSI standard in that they did not have side shields and were not marked to indicate that all requirements of the ANSI standard were met.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.132(f)(3)(i):  The employer did not retrain employees when changes in the workplace rendered previous training obsolete:    On or about October 26, 2017, employees were exposed to caught-in and laceration hazards when employees handling sheet metal on a National roll bending machine in the bellows department.  Employees were not provided with effective retraining when their job duties changed to operation of the roll bending machine during which the use of gloves was prohibited.
