29 CFR 1910.28(b)(12)(i): The employer did not ensure that each employee on a scaffold was protected from falling in accordance 29 CFR part 1926, subpart L: a) Job site, 237 7th Avenue, Pittsburgh, PA: On or about October 30, 2017, during marquee letter changing activities, the employer did not ensure that employees used appropriate fall protection systems/devices while operating a Genie brand scaffold unit in that the mid rail had been raised up and secured in place to the top rail along the upper portion of the basket railing system, leaving a large opening to exist at the basket entry area, exposing an employee to a fall hazard of approximately 15 feet.
