29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) 28 Stonewold Way, Wilmington, DE - On or about November 8, 2017, the employer failed to provide safe access to a fabricated frame scaffold. Employees accessed three levels of scaffold by climbing the scaffold frames which were not specifically designed and constructed for use as ladder rungs.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) 28 Stonewold Way, Wilmington, DE- On or about November 8, 2017, the employer failed to ensure employees performing work on a fabricated frame scaffold had received training in the recognition of hazards associated with scaffolding or the manner in which to control or minimize hazards. Abatement Note: The training program must be by a qualified person the type of scaffold being used to control or minimize the hazards. Training should include the following applicable areas: 1. Nature of any electrical hazards, fall hazards and falling objects in the workplace area. 2. Correct procedures for dealing with electrical hazards and for erecting, maintaining and disassembling the fall protection system, and falling object protection system being used. 3. The proper use of the scaffold, and the proper handling of materials on the scaffold. 4. The maximum extended load and the load-carrying capacities of the scaffold used and any other pertinent requirement.
