29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) For the restaurant location as occurring on or about 11/06/2017, an employee working on a flat roof that was 11-12 feet high, removing a parapet wall in preparation to install a new parapet, was not protected from falling off of the unprotected edge with any kind of fall protection. Employee was exposed to fall hazards from the open edges of the roof and also for a cooler where the ladder to gain access to the roof was located. The cooler was 10 feet 8 inches high and employees had to walk onto the cooler to gain access to the roof.

The employee was not utilizing fall protection and was not aware of the height where fall protection was required.
