29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    A)    Kay Toledo Tag, Inc., located at 6050 Benore Road, Toledo, OH 43612: On or about September 7, 2017, the employer did not establish and utilize specific procedures to control hazardous energy of the equipment such as, but not limited to, the New Era Wire Machine # 6 (Model # WM 100, Serial # W 206) located in the Finishing Department. Employees did not control all hazardous energy sources such as, but not limited to, electrical before performing activities such as, but not limited to, unjamming or rethreading a wire. Employees were exposed to laceration hazards while all hazardous energy sources were not controlled prior to conducting work.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):     A)    Kay Toledo Tag, Inc., located at 6050 Benore Road, Toledo, OH 43612: On or about September 7, 2017, the employer did not ensure that all the steps outlined in 29 CFR 1910.147(d) and required for the control of the hazardous energy sources such as, but not limited to, electrical were followed before employees conducted activities such as, but not limited to, unjamming or rethreading a wire on the equipment such as, but not limited to, the New Era Wire Machine # 6 (Model # WM 100, Serial # W 206) located in the Finishing Department. Employees were exposed to laceration hazards while all hazardous energy sources were not controlled prior to conducting work.       As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lock-out/tag-out device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from amputation hazards while employees conduct maintenance activities such as, but not limited to, unjamming the wire machine.

The employee was exposed to blood-borne hazards while the employee cleaned the New Era Wire Machine # 6 (Model # WM 100, Serial # W 206) and the area where one employee suffered severe laceration of the palm on the right hand.

Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program:     A)    Kay Toledo Tag, Inc., located at 6050 Benore Road, Toledo, OH 43612: On or about September 7, 2017, the employer did not ensure that each employee with occupational exposure to blood-borne hazards was trained in accordance with the 29 CFR 1910.1030 standard. Such training should have taken place at the time of the employees initial assignment, and should have covered items such as, but not limited to, a copy of the regulatory text of the 1910.1030 standard, explanations of the modes of transmission of blood-borne pathogens, and a general explanation of the epidemiology and symptoms of blood-borne diseases.
