The most recent occurrence of this was evident on Nov 15, 2017 at the Apple Creek Apartment complex located at 14114 Kent St. Omaha, NE where the employer had an employee painting the 2nd floor exterior of the apartment building over 18 feet above the ground by operating a Genie S85 model aerial lift without wearing a harness and lanyard.

29 CFR 1910.134(k)(6): This standard is applicable to construction work under this standard: 20 CFR 1926.103: The employer did not provide the basic advisory information on respirators, as presented in Appendix D of this section, in written or oral format to employees who wear respirators when such use was not required by the employer: The employer is failing to protect employees from respiratory hazards associated with the voluntary use of N95 dust masks. The most recent occurrence of this was evident on Nov 15, 2017 at the Apple Creek Apartment complex located at 14114 Kent St. Omaha, NE where the employer had an employee voluntarily wearing an N95 dust mask for nuisance dust while painting the 2nd floor exterior of the apartment building without having briefed the employee on the requirements contained in appendix D of this subpart.
