29 CFR 1926.451(a)(6): Scaffolds were not loaded in accordance with the design by a qualified person:  OR IN THE ALTERNATIVE   Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from a 12 foot long platform elevated by a telehandler and an eight foot long platform elevated by a telehandler.  (a) On or about November 16, 2017 for employees exposed to fall hazards up to 30 feet while working on elevated work platforms up to 12 feet long, attached lengthwise to the forks of JCB 510-56 Telehandlers at or near 1709 35th Street South in Fargo, North Dakota.  Abatement Note: Among other means, feasible and acceptable methods to correct the hazard would be to follow ASME B56.6b - 1992 Safety Standard for Rough Terrain Forklift Trucks including but not limited to: 1. Use a platform that does not extend more than two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck. 2. Use an alternative means to elevate employees to working levels.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not capable of supporting at least 5,000 pounds per employee attached.  (a) On or about November 16, 2017 for employees exposed to fall hazards while working on elevated work platforms, up to 30 feet high, utilizing the guard railings of work baskets attached to the forks of JCB 510-56 Telehandlers as anchor points at or near 1709 35th Street South in Fargo, North Dakota.
