29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. Location: 163 Bloomfield Ave., Verona NJ. a) Employees were observed using the third level's side bracket of a tubular welded scaffold that was not provided with a guardrail system and the employees did not have a PFAS thereby exposing the workers to a potential fall hazard of approximately 21 ft to the ground below; on or about 11/9/17.

Location: 163 Bloomfield Ave., Verona NJ. a) Employees were observed using the second, third, fourth, fifth and sixth level of a tubular welded scaffold while engaged in dismantling operations thereby exposing employees to a potential fall hazard of up to 48 ft. to the ground below. The employees on the second level were stationary (i.e., they were receiving wood planks); the component person did not determine if fall protection was feasible; on or about 11/9/17.

The employee tied off to the scaffold components and the employer did not provide evidence that the scaffold components were able to support at least 5,000 lbs. The employee was exposed to a potential fall of to approximately 40 ft. to the ground below; on or about 11/9/17.
