29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Shorten Construction, Roof - 2 Biltmore Rd, Worcester, Massachusetts; On November 20, 2017 four employees were performing roofing repairs on a two story residential roof and the employees were exposed to fall hazards greater than 15 feet to the ground below without being protected by guardrail systems, personal fall arrest systems or other approved measures.

Shorten Construction, 62 Woodside Road, Spencer, Massachusetts; On and before November 20, 2017, the employer did not provide a ladder safety training program that enabled the employees to recognize the hazards associated with climbing ladders including but not limited to: a. ensuring the ladder locking mechanisms were properly in place to prevent the ladder from moving while in use b. identifying the proper angle ladders were to be erected and how to determine if they are set up properly
